EmployeeConnect will comply with the Privacy Laws in the same way and to the same extent as the Customer would have been bound by and required to comply with these laws had the act or practice been directly done or engaged in by the Customer.

5. Handling of Personal Information

When EmployeeConnect has access to personal information in order to perform its obligations pursuant to this agreement, we commit to the following:

  • Compliance: We will ensure that all relevant personnel of EmployeeConnect comply with the Privacy Laws.
  • Non-breach: We will not do or omit to do anything that causes or is likely to cause the Customer to breach its obligations under any Privacy Laws.
  • Customer Instructions: We will comply with any reasonable request, direction, or instruction provided by the Customer regarding the collection, storage, use, disclosure, or management of the personal information.
  • Access Requests: If we receive a request from an individual for access to, alteration, correction, or deletion of personal information, we will promptly notify the Customer in writing and comply with any reasonable and lawful direction issued by the Customer.
  • Limited Access: We will only access, copy, view, or use personal information as needed to provide the services pursuant to this agreement and for no other purpose.
  • Non-disclosure: We will not disclose, transfer, or provide any personal information to a third party without the prior written consent of the Customer, including third parties located outside Australia.
  • Notification of Breach: We will notify the Customer immediately if we become aware that any disclosure or use of personal information may have been made in contravention of any Privacy Law or this agreement.

6. Data Breach

EmployeeConnect is committed to preventing and detecting data breaches in accordance with good industry practice. In the event of an actual or suspected data breach, we will take the following steps:

  • Notification: We will notify the Customer of the breach within 24 hours of becoming aware and provide ongoing disclosure of all relevant information.
  • Mitigation: We will take all reasonable steps to mitigate any adverse effects arising from the breach and to remedy the situation.
  • Prevention: We will take steps to prevent the potential data breach from becoming an actual breach and prevent any recurrence.

7. Data Residency

All data processed during the course of this agreement will be hosted and stored within Australia.

8. Data Retention

We will retain your personal information only for as long as necessary to fulfil the purposes for which it was collected, unless a longer retention period is required or permitted by law.

  • Request correction or deletion of your personal information.
